Small claims monetary jurisdiction
As of October 1, 2025, the monetary jurisdiction of the Ontario Small Claims Court has increased from $35,000 to $50,000 pursuant to O. Reg. 42/25 under the Courts of Justice Act.
This change allows individuals and businesses to pursue higher-value claims through a more efficient and cost-effective process, without needing to proceed in the Superior Court of Justice. For many small businesses in particular, this expansion improves access to justice and simplifies the recovery of debts and damages. As a result, a broader range of disputes can now be resolved through Small Claims Court.
The same monetary increase also applies to matters before the Landlord and Tenant Board.
virtual hearings at the landlord & tenant board
The Landlord and Tenant Board continues to expand the use of electronic hearings under the authority of the Statutory Powers Procedure Act and the Residential Tenancies Act, 2006. Virtual hearings (by videoconference or telephone) are now the default in many cases, with in-person hearings granted only in limited circumstances.
This shift aims to increase efficiency and reduce backlog, but it also requires parties to be prepared to present their case remotely.
Understanding procedural requirements for electronic hearings is now essential for both landlords and tenants.
upcoming ltb procedural reforms
Ontario has introduced legislative reforms through Bill 60, the Fighting Delays, Building Faster Act, 2025, which amend the Residential Tenancies Act, 2006.
Proposed changes include shorter eviction notice periods, new rules regarding persistent late payment of rent, and stricter requirements for tenants raising issues in proceedings.
Additional reforms aim to standardize forms, limit review timelines, and streamline Landlord and Tenant Board processes.
While Bill 60 received Royal Assent on November 27, 2025, the amendments aimed at reducing delays and improving efficiency are not yet in force.
